Riverhill Country Club

These Terms & Conditions (the “Terms”) govern your access to and use of the Riverhill Country Club website and its member and staff portals (together, the “Site”), operated by Riverhill Country Club (“Riverhill,” “the Club,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
These Terms govern your use of the Site only. They do not replace or modify your membership agreement, the Club’s bylaws, rules, or policies, or any billing arrangement with the Club, each of which is governed by its own terms. If these Terms conflict with your membership agreement, the membership agreement controls as to membership matters.
1. Who May Use the Site
The Site is intended for Club members, their families and authorized household members, Club staff, and invited guests. Some areas—such as the member and staff portals—are restricted and require sign-in. You may use those areas only if the Club has provided you access, and only for their intended purpose. You are responsible for ensuring that anyone in your household who uses the Site through your account complies with these Terms.
2. Accounts and Sign-In
- The member and staff portals use a passwordless “magic link” sign-in. When you request access, we send a one-time link and code to the email address or phone number on file for your account.
- Sign-in links and codes are personal to you. Do not share them, and do not attempt to access an account that is not yours.
- You are responsible for keeping your contact information current and for activity that occurs under your account. Notify us promptly if you believe your account has been used without your permission.
- We may suspend, limit, or terminate access to the Site or any account at any time if we believe these Terms have been violated or to protect the Club, its members, or the Site.
3. Event Reservations (RSVPs)
- Reservations made through the Site are requests to attend Club events and are subject to availability, capacity limits, guest policies, and any event-specific rules.
- When an event is at capacity, reservations may be placed on a waitlist. A waitlisted reservation is not confirmed unless and until space becomes available and you are notified.
- You agree to provide accurate reservation details, including an honest party size, and to honor the Club’s cancellation and no-show expectations. Repeated no-shows or misuse of the reservation system may result in limits on your ability to reserve.
- Any charges associated with an event (for example, dining or event fees) are governed by the Club’s billing arrangements, not by these Terms, and are not collected through the Site.
4. Acceptable Use
When using the Site, you agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms or Club rules.
- Access, or attempt to access, accounts, data, or areas of the Site you are not authorized to use.
- Interfere with or disrupt the Site, its security, or its underlying infrastructure, including by introducing malware, scraping, or automated access without our permission.
- Submit false, misleading, or fraudulent information, including in reservations or profile updates.
- Upload or transmit content that is unlawful, harassing, defamatory, or infringes the rights of others.
- Use the Site to send unsolicited messages or to collect information about other members.
5. Club Content and Intellectual Property
The Site and its content—including text, photographs, graphics, logos, the Riverhill name and marks, page designs, and software—are owned by or licensed to the Club and are protected by intellectual-property laws. You may view and use the Site for your personal, non-commercial use as a member, guest, or staff member. You may not copy, reproduce, distribute, modify, publicly display, or create derivative works from Site content without our prior written permission, except as allowed by law.
6. Information You Submit
You are responsible for the accuracy of information you submit through the Site, such as contact details, household information, and reservation notes. By submitting information, you represent that you have the right to provide it and that it is accurate. We may use and store the information you submit as described in our Privacy Policy.
7. Third-Party Services and Links
The Site relies on third-party service providers (for example, for hosting, email, text messaging, and content delivery) and may link to third-party websites. We do not control, and are not responsible for, the content, products, or practices of third parties. Your use of third-party services is subject to their own terms and policies.
8. Communications
By providing your email address or phone number and choosing to receive communications, you consent to receive Site-related and Club communications through those channels, including transactional messages such as one-time verification codes, secure sign-in links, reservation confirmations, and other messages you specifically request or opt in to. Message frequency varies. Message and data rates may apply to text messages. You can manage your communication preferences or opt out where applicable as described in our Privacy Policy.
9. Disclaimers
The Site is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components, or that any information on the Site is complete or current. Event details, schedules, and availability may change.
10. Limitation of Liability
To the fullest extent permitted by law, Riverhill Country Club and its owners, officers, employees, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, use, or goodwill, arising out of or relating to your use of (or inability to use) the Site. Nothing in these Terms limits liability that cannot be limited under applicable law. This section does not affect any rights or obligations arising under your membership agreement.
11. Indemnification
You agree to indemnify and hold harmless Riverhill Country Club and its owners, officers, employees, and service providers from any claims, losses, or expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site or your violation of these Terms or the rights of others.
12. Changes to the Site and These Terms
We may modify, suspend, or discontinue any part of the Site at any time. We may also update these Terms from time to time. When we do, we will revise the “Effective date” above and, where appropriate, notify members. Your continued use of the Site after an update means you accept the revised Terms.
13. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You agree that any dispute relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Kerr County, Texas, and you consent to their jurisdiction, except where prohibited by applicable law.
